1. GENERAL INFORMATION

In compliance with the provisions of Royal Decree 1906/99 of December 17, which regulates electronic contracting with general conditions, and the Retail Trade Regulation Act (Law 7/1996 of January 15, amended by Law 47/2002 of December 19) as applicable to the provisions on distance sales in articles 38 and following.

This document constitutes the general regulation of the services provided by Kalliwoda Invest, SL, through the website www.andresmachado.com, constituting the legal framework that develops this contractual relationship of purchase-sale.

These General Conditions are subject to the provisions of Law 7/1988, of April 13, on General Contracting Conditions, Law 26/1984, of July 19, General for the Defense of Consumers and Users, amended by Law 39/2002, of October 28, transposing into Spanish law various community directives on the protection of the interests of consumers and users, which incorporates the amendments introduced by Law 22/2003, of July 9, on bankruptcy, and incorporates the amendments introduced by Law 23/2003, of July 10, on Guarantees in the Sale of Consumer Goods, Royal Decree 1906/1999, of December 17, 1999, regulating Telephone or Electronic Contracting with general conditions, Organic Law 15/1999, of December 13, on the Protection of Personal Data, Law 7/1996, of January 15, on the Regulation of Retail Trade, amended by Law 47/2002 for the transposition into Spanish law of Directive 97/7/EC, on distance contracts, and for the adaptation of the Law to various Community Directives and Law 34/2002 of July 11, on Information Society Services and Electronic Commerce.

The services offered by Kalliwoda Invest, SL may be contracted by any user who meets the requirements established in these CONTRACTING CONDITIONS and LEGAL NOTICE available at all times on the Website www.andresmachado.com.

2. PURPOSE OF THE CONTRACT

The contract aims to regulate the general conditions of the service offered by Kalliwoda Invest, SL. The services that Kalliwoda Invest, SL currently provides and that are the subject of this contract are the online sale of footwear.

Access to information is completely free, while the product purchase service is costly, with current product prices, shipping costs, and tax charges being specified at all times.

The contracting process will be carried out in Spanish in all cases, although Kalliwoda Invest, SL may establish the possibility of contracting the service in other specified languages.

3. IDENTIFICATION OF THE CONTRACTING PARTIES

And, on the other hand, by the CUSTOMER, whose data entered to make the purchase or to make a suggestion, through the form established for this purpose, are those that have been entered by themselves.

All data included in it has been entered directly by the CLIENT, so the responsibility for the authenticity of the same corresponds, directly and exclusively, to the CLIENT.

4. OBLIGATIONS RELATING TO THE PURCHASE PROCEDURE

The CUSTOMER is solely responsible for the accuracy of the data entered during the purchasing process and accepts the obligation to provide truthful, accurate, and complete data.

If the CLIENT fails to comply with this obligation, they will be responsible for any damages caused to www.andresmachado.com or a third party.

5. CONDITIONS OF SERVICE

The terms and conditions of this service and any offers that may be made through www.andresmachado.com always appear on the Website and can therefore be consulted, archived, or printed. www.andresmachado.com reserves the right to modify these Terms and Conditions, as well as any other document posted on the Website, at any time.

6. RESPONSIBILITIES

www.andresmachado.com will not be liable for any delays or failures that may occur in the access, functioning and operation of the Website, or in its services and/or contents, nor for any interruptions, suspensions or malfunctions thereof, when they are caused by breakdowns caused by natural disasters or situations of force majeure, or extreme urgency, such as strikes, computer attacks or intrusions or any other situation of force majeure or fortuitous cause, as well as for errors in the telematic data transfer networks and in any case when the error has been produced by a third party outside the business Organization of www.andresmachado.com.

www.andresmachado.com is responsible for the reliability, truthfulness, and accuracy of the content, data, or information regarding the products offered on its Website, unless these have been modified by third parties, whether external or not to the organization, without express authorization from the company. The service provided by www.andresmachado.com is limited exclusively to making the products offered on the Website available to customers.

The CUSTOMER agrees to comply with the provisions of the LEGAL NOTICE and the CONTRACTING CONDITIONS published by www.andresmachado.com on its Website at the time of purchase of the product.

7. PURCHASE PROCEDURE

All products displayed on the website www.andresmachado.com are presented in EUROS and include 21% VAT in the price.

As of today, the service contracting process is carried out entirely electronically, and you must be registered as a Website user to begin. The steps for completing the contract are as follows:

1. Search for Items

The store displays the item search on the left side, where you can search for an item based on the string entered in the form. The existing sections or categories are also displayed in the left margin. Clicking on the categories will show you the different subcategories that depend on them in the center. Categories that have subcategories are distinguished by being right-aligned or ending with a symbol.

On each category or subcategory page, you will see products on sale or recommended by Andrés Machado. From this page you can also access the list of all items in the current category. Clicking on an item will take you to that product's specific listing with detailed information, a photo, and its price in euros. Some product listings may include a selector to determine the product's different characteristics or varieties (color, size, etc.). These characteristics may affect the price of the item, which will be displayed when selected.

2. Add Items to Your Cart

To add any item to your cart, click the [buy] link or the shopping cart icon from the storefront, the item information, or the category listing. You can always view your cart by clicking the [view cart] link in the mini-cart. While browsing the store, the mini-cart is always displayed, providing a summary of your cart status. Once in the cart, you can modify the units of an item, delete items, and view the amount of your order. From the cart, you can complete the final purchase by clicking the [Process order] link.

You can also add items to your cart from your personal area, "Your Orders," where your details and purchase history are displayed. Each listed order has a link so you can add items from that order to your current cart, saving you time browsing the store if you need to repeat a previous order. Of course, you can make any necessary changes to your new order in your cart.

3. Log In

The next step is to log in with your email and password if you are already an Andrés Machado customer, or fill out the customer form if this is your first time shopping at our store. Once logged in, you will see a screen with your billing and shipping information, the amount of the items, the shipping costs (which you must select based on your shipping information), and choose your payment method.

4. Finalize Your Order

Once you have verified that all the information is correct, click the [Finalize Order] button to confirm and close the order. After this, a screen will appear indicating the order number assigned to your purchase and other details.

8. SHIPPING OF THE PRODUCT

We have all the products on offer in stock. This allows us to process orders confirmed on weekdays before 2:00 PM and ship them that same day for delivery within the next 24/48 business hours (mainland Spain) via the selected shipping agency. However, delivery may take longer than stipulated during promotional periods.

If you choose Cash on Delivery as your payment method, there is an additional charge corresponding to the shipping agency's commission of 5% with a minimum of 3 euros plus 21% VAT. If you choose this payment method, we need to contact you by phone before shipping to verify your details. Failure to confirm your details may result in the cancellation of the order.

9. VALIDITY OF THE PURCHASE PROCEDURE AS PROOF OF ACCEPTANCE

Both parties expressly declare that the acceptance of the service offer of www.andresmachado.com by the CLIENT is carried out by following the purchase procedure described in section 7, PURCHASE PROCEDURE of these contracting conditions.

The fact of following electronically all the steps described in section 7 for the process of purchasing the products and accessories by the CUSTOMER, implies the full and express acceptance of these general contracting conditions, understood as sufficient to contract.

The contract will be concluded from the date the CUSTOMER agrees to the published terms and conditions at the time of purchase, and must expressly accept them.

10. LEGAL RIGHT TO WITHDRAW FROM THE PURCHASE

10.1. Right of Withdrawal

If you are contracting as a consumer and user, you have the right to withdraw from this contract within 14 calendar days without giving any reason. The withdrawal period will expire 14 calendar days after the day on which you or a third party indicated by you, other than the carrier, acquired physical possession of the goods, or if the goods comprising your order are delivered separately, 14 calendar days after the day on which you or a third party indicated by you, other than the carrier, acquired physical possession of the last of those goods.

To exercise your right of withdrawal, you must notify KALLIWODA INVEST SL, at the address Calle Calafates 6, (Pol. Ind IN-II), Santa Pola (Alicante), Spain, at +34 656 814 096 / +34 666 258 252, by writing to us at info@andresmachado.es or by using our contact form, of your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post or email).

You may use the model withdrawal form that you can download, although its use is not mandatory. To comply with the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of this right before the corresponding deadline expires.

10.2. Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method we offer), without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.

We will process the refund using the same payment method used by you for the initial transaction. You will not incur any costs as a result of the refund. Notwithstanding the foregoing, we may withhold the refund until we have received the goods back or until you have provided proof of their return, whichever is earlier.

You must return or deliver the products directly to us at the aforementioned address without undue delay and, in any event, no later than 14 calendar days from the date on which you notify us of your decision to withdraw from this contract. The deadline will be deemed to have been met if you return the goods before the deadline has expired.

The cost of returning the goods will always be borne by the consumer in whatever manner they deem appropriate. You will only be liable for any diminished value of the goods resulting from handling other than that necessary to establish the nature, characteristics, and functioning of the goods.

10.3. Contractual Right of Withdrawal

In addition to the legally recognized right of withdrawal for consumers and users mentioned in this section, we grant you a period of 30 days from the Shipping Confirmation to return products. If you return the products within the contractual period of withdrawal, but after the statutory period has elapsed, you will only be refunded the price paid for such products.

You will be responsible for the direct costs of returning the product. You may exercise your right of withdrawal in accordance with the provisions of clause 10.1 above. However, if you notify us of your intention to withdraw from the contract after the statutory withdrawal period has elapsed, you must in all cases return the goods to us within 30 days from the Shipping Confirmation.

Your right to withdraw from the contract will apply exclusively to products returned in the same condition as when you received them. No refund will be issued if the product has been used beyond its mere opening, for products that are not in the same condition as when they were delivered, or for products that have suffered any damage. Therefore, you must take care of the products while they are in your possession.

Please return the item using or including all its original packaging, instructions, and any other accompanying documents. In any case, you must submit the duly completed receipt you received upon delivery along with the product to be returned.

If you wish to return the products, you will be responsible for the return shipping costs. We recommend using Correos as the easiest and most economical way. Please note that if you decide to return the items to us freight collect, we will not accept the package.

After examining the item, we will inform you if you are entitled to a refund of the amounts paid. Shipping costs will only be refunded if the right of withdrawal is exercised within the statutory deadline and all items included in the order in question are returned.

The refund will be made as soon as possible and, in any case, within 14 calendar days from the date you notified us of your intention to withdraw. However, we may withhold the refund until we have received the goods or until you have provided proof of having returned the goods, whichever is met first.

The refund will always be made using the same payment method you used to pay for the purchase. If you paid by direct deposit, bank transfer, or cash on delivery, you must provide us with your account number so we can process the corresponding transfer.

11. PURCHASE GUARANTEE

If you purchase products as a consumer or user, we offer warranties on the products we sell through this website, in accordance with the legally established terms for each type of product. We are therefore liable for any lack of conformity that becomes apparent within two years of delivery.

It is understood that the products are in compliance with the contract provided that (i) they conform to the description made by us and possess the qualities that we have presented on this website, (ii) they are suitable for the uses to which products of the same type are ordinarily intended and (iii) they present the quality and performance usual for a product of the same type that can reasonably be expected.

The measurements in centimeters (CM) shown on each product are indicative and approximate and are not contractual in nature.

In this regard, if any of the products do not comply with the contract, you must inform us by following the procedure detailed in the Complaints section within the "Exchanges and Returns" section and through any of the methods we mention therein.

Products will be exempt from the warranty if the damage or deterioration is caused by use by the customer, and not by manufacturing defects or flaws.

To apply the product warranty, it is essential that the customer present the receipt or invoice provided to them when they purchased the product or when it was delivered.

12. PARTIAL NULLITY

If any part of these Terms of Service is found to be unlawful and therefore invalid, this will not affect the remaining legally binding provisions. The parties agree to renegotiate any parts of the Terms of Service that are deemed invalid and incorporate them into the remaining Terms of Service.

13. APPLICABLE LAW AND JURISDICTION

All matters relating to the Website are governed in each and every respect by Spanish law. Any dispute arising out of or related to the use of the Website shall be subject to the non-exclusive jurisdiction of the Spanish courts.
